Employment law governs the relationship between employer and employee from recruitment to the end of the employment contract. Its main sources are the Labour Law No. 4857, the Occupational Health and Safety Law No. 6331 and the Social Insurance and General Health Insurance Law No. 5510. Foreign nationals may work in Turkey only with a work permit under the International Labour Force Law No. 6735.
Drafting employment contracts, workplace regulations and HR policies in line with the legislation reduces future disputes over working hours, overtime, annual leave and wage payments. Non-compete and confidentiality provisions are valid only if they meet the statutory conditions.
Termination is the stage that most often gives rise to employment disputes. Mediation is a mandatory pre-condition to filing a lawsuit for severance and notice pay, employee receivables and reinstatement claims. The parties may also end the relationship by mutual termination agreement, which requires, among other things, that the employee receive a reasonable benefit.
Our firm advises employers and employees at every stage of the employment relationship and represents them in mediation and before the labour courts.
